New York & Company, Inc. is a leading specialty manufacturer and retailer of women's fashion apparel and accessories offering NY Style at Great Deals. The Company was incorporated in 1918 and has been public since 2004. It is headquartered in New York City.

New York & Company's proprietary branded New York & Company merchandise is sold exclusively through its national network of nearly 600 New York & Company retail stores and E-commerce store at nyandcompany.com. In 2008, New York & Company had revenue of $1.1 billion and increased its online presence significantly.

Merchandise Offerings

New York & Company carries 100% private label apparel and accessories. The fashion assortment features wear-to-work styles such as stretch shirts and sophisticated suits, casual and denim collections, and a wide range of trendy seasonal styles. Special styles and sizes are available exclusive online at nyandcompany.com.

In September 2008, the Company launched the New York & Company Red Label Collection, the Style of the City. Straight off the runway, this is a premium new fashion collection that captures the essence of modern NY Style. It is available in limited edition in most major markets and offered online at nyandcompany.com.

In November 2008, the Company introduced the InMotion Fitness Collection for serious workout style. The collection features CityCool, an advanced wicking technology that draws moisture to the fabric's surface where it quickly evaporates, keeping you cool, dry, and comfortable. InMotion performs at the gym or yoga class, and still looks sexy when running errands.

In January 2009, the Company launched the NY Swim Collection, offering bikinis, tankinis, one-pieces and cover-ups, available online and in select stores.

Terms and Conditions
New York & Company has a zero tolerance policy on publisher violation of the Terms and Conditions. The policy provides for potential withholding of all affiliate commission or removal from the program for publishers in violation of the policy retroactively for the entire month the violation occurs. Please refer to your affiliate network contact or interface for further explanation and a detailed list of keywords.

• Affiliates may only use approved text, offers, banners, and links provided by New York & Company or the associated affiliate network strictly for use via the Affiliate Program.
• New York & Company does not permit unauthorized coupons, offers, copy or descriptions to be posted online or promoted through any other means.
• Affiliates shall not bid on search terms or keywords for "New York & Company" and "Lerner", or any variation thereof or any registered trade or product name.
• Affiliates cannot include any of New York & Company's trademarked brand names and domains in meta-tags and/or title tags for search result purposes.

All you need to do is post our links and banners on your site and send traffic to us, and we handle all the orders, fulfillment, and customer support. We partner with you to create compelling promotions and special programs to drive revenue.

How do I get started?
Select the affiliate network of your choice. Our promotions and commission rates are the same for both networks; we do not differentiate the networks in any way. So choose the network and send in your application. sign up now

How long does the acceptance process take?
It generally takes less than two weeks to let you know the status of your application.

Are there any restrictions on who can join the program?
We would like everyone to promote our site, but there are cases where we cannot allow certain sites to participate in our Affiliate Program. We will evaluate each application in good faith. Unsuitable sites include those that:

• Promote sexually explicit materials
• Promote violence
• Promote illegal activities
• Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation
• Promote click fraud and/or fraudulent orders
• Promote gambling
• Violate our terms and conditions
• Have a customer base outside the US
• Are based in the US but purchase for customers outside the US and ship to those customers

My website is based outside the US. Can I still become an affiliate?
If your customers are primarily in the US, you can still become an affiliate. However, if your customers are based outside the US, we will not accept the application because we do not ship outside the US.

If I have more than one site, can I join with both?
Yes. Your network agency will help you set up an account for all related sites.

Will becoming an affiliate increase traffic to my site?
Our site is not designed to send traffic to affiliates. However, if you use our content, customers will know where to find the best deals and come back to your site.

How do I create links to New York & Company?
Once you have been accepted into the program, our network agencies will help you set up an account with them, and provide you with all links and banners.

Who handles customer service?
New York & Company has a great call center and Customer Service section on the website that handles all customer service related topics.

What is the commission rate?
We offer competitive commissions that vary depending on seasonal incentive programs.

How often do I get paid?
We send payment each month.

Do I earn commissions on returns?
At this time we do not track returns from our website purchases, so there is no way for us to revert commissions. So yes, you do earn commissions on returns. New York & Company reserves the future right to deduct returns from commissions or exclude sales deemed to be fraudulent.

How can you tell that orders came from my site? Will I get paid on all orders?
If you use all links and banners from your network interface, we will be able to track all orders and pay you a commission on every sale generated.

Can we join both network agencies?
Since we have the same promotions, commission structures, and incentive programs with both networks, there is no need to join both programs. We discourage affiliates from joining both networks in order to manage the program better. If an affiliate is in one program, the affiliate is declined from another. However, if you feel strongly about working with one specific network, please feel free to contact us and we will review on a case-by-case basis.

Why does New York & Company work with more than one network?
We work with two networks because we wanted to increase the reach of our program and increase speed of expansion.

Which network should I join?
We do not promote one network over the other. It does not matter which network you join because we have the same promotions, commission structures, and incentive programs with both networks. We do not differentiate between the two.

American Heart Association
Heart disease is a leading cause of death among women. Each February, we partner with the American Heart Association to sell a product in our stores and donate proceeds to AHA. With our support, the AHA is able to work towards their mission of reducing disability and death from cardiovascular diseases and strokes.

Breast Cancer Research Foundation
It's important for us to support causes that affect the lives of women. Each October during Breast Cancer Awareness Month, we sell a product in our stores and donate proceeds to the Breast Cancer Research Foundation (BCRF). Through our partnership with the BCRF, we are working toward prevention, and ultimately, a cure in our lifetime.

St. Jude Children's Research Hospital®
New York & Company is proud to support St. Jude Children's Research Hospital, internationally recognized for its pioneering research and treatment of children with cancer and other life-threatening diseases. The hospital's research has helped push overall survival rates for childhood cancer from less than 20% when the institution opened to almost 80% today. It is the first and only National Cancer Institute-designated Comprehensive Cancer Center devoted solely to children, and no family ever pays St. Jude for care.

New York & Company joined as a St. Jude partner in 2008, participating in the annual St. Jude Thanks and Giving® campaign to benefit St. Jude. In our first year, we were named "New Corporate Partner of the Year" by St. Jude for outstanding fundraising. Since then, we have raised more than $7.6 million for this amazing cause. We are very grateful to our loyal customers who join us wholeheartedly in supporting the St. Jude mission of finding cures and saving children battling deadly diseases. As an organization and as a team, we look forward to supporting St. Jude each upcoming holiday season because we know "Some Gifts Count More Than Others."

United Way
Over the past several years, New York & Company has raised over $3 million for United Way. We have achieved this with the help of our Brand Headquarters associates. We also sponsor a Corporate Match Program, donating up to a dollar for every dollar donated. In addition, we offer quarterly volunteering events for our associates to assist in soup kitchens, child care centers and senior citizen communities.
